Terms of Service

1. Your account

You must provide accurate information when you create an account and keep it up to date. You are responsible for the activity under your account and for keeping your credentials secure. You must be at least 13 years old to use the Service. Notify us promptly at support@smara.us if you believe your account has been compromised.

2. Your content

You retain ownership of the material you upload and the decks, cards, quizzes, and exams you create (“Your Content”). You grant Smara a limited license to store, process, and display Your Content solely to operate and improve the Service for you — including sending it to our AI and infrastructure providers to generate and serve your study materials. You are responsible for having the rights to any material you upload, and for ensuring it does not infringe others’ rights or violate the law.

3. AI-generated study materials

Smara uses automated AI models to generate flashcards, quiz questions, and exams from your material. AI output can be incomplete, inaccurate, or wrong. The Service is a study aid, not a source of professional, medical, legal, or academic advice. Always verify generated content against authoritative sources before relying on it, especially in clinical, safety-critical, or examination contexts. You use AI-generated content at your own discretion and risk.

4. Acceptable use

You agree not to:

• upload material you do not have the right to use, or that is unlawful;
• attempt to break, overload, reverse-engineer, or circumvent limits of the Service;
• use the Service to generate unlawful, harmful, or abusive content;
• resell or redistribute the Service or access to it without permission.

We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for Smara or other users.

5. Plans, billing, and refunds

Smara offers a free plan and a paid “Pro” subscription ($6/month or $48/year). Paid subscriptions are billed in advance through our payment processor, Stripe, and renew automatically each billing period until you cancel. You can cancel any time from your billing settings; cancellation stops future renewals and your Pro access continues until the end of the current paid period.

Because the Service has real per-use costs, fees are generally non-refundable except where required by law. If you believe you were charged in error, contact support@smara.us within 14 days and we will review your case in good faith. We may change plan prices or features with reasonable notice; changes do not affect the period you have already paid for.

6. Service availability

We work to keep the Service available and reliable, but it is provided “as is” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that it will preserve your data indefinitely. Keep your own copies of material that matters to you; export tools are provided for this purpose.

7. Limitation of liability

To the maximum extent permitted by law, Smara and its operators will not be liable for any indirect, incidental, or consequential damages, or for lost data, profits, or study outcomes, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

8. Governing law

These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in [STATE], and you consent to their jurisdiction.

9. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the revised Terms.
